Terms of Service

These Terms of Service ("Terms") govern your use of the Pointscape mobile application and related services (collectively, the "Service") operated by Pointscape ("we", "our", or "us"). By using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use Pointscape. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

Pointscape offers free and paid subscription tiers (Pro and Cloud). Paid subscriptions are billed through the Apple App Store and are subject to Apple's terms of service and payment policies.

• Free (Explorer) — basic viewing with limited local files and point counts.
• Pro — advanced visualization, all coloring and quality modes, unlimited local files and points per file.
• Cloud — everything in Pro plus cloud upload, streaming, offline download, and team workspaces.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple ID account settings. Add-ons for additional storage or team seats are available as separate purchases.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Upload or share content that infringes on the intellectual property rights of others.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Use automated tools to access the Service without our written consent.
• Share your account credentials or allow others to access your account.

5. Your Content

You retain ownership of all point cloud files and data you import, upload, or create using Pointscape ("Your Content"). By uploading content to our cloud services, you grant us a limited license to store, process, and transmit Your Content solely to provide the Service to you and your workspace members.

You are responsible for ensuring you have the necessary rights to any files you upload. We do not monitor or review the content of your point cloud files.

6. Workspaces and Collaboration

Cloud tier users can create workspaces and invite team members. Workspace owners are responsible for managing access and permissions. When you share content within a workspace, other members of that workspace can view and download that content according to their role permissions.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify you of planned downtime.

8. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by Pointscape and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets except as needed to use the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Pointscape shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Cloud-stored data will be deleted within 30 days of account termination unless required by law to be retained.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing formal dispute resolution.
